Article 4 : Market surveillance of machinery directive 2006/42/EC

Article 4 :  Market surveillance

Member States shall take all appropriate measures to ensure that machinery may be placed on the market and/or put into service only if it satisfies the relevant provisions of this Directive and does not endanger the health and safety of persons and, where appropriate, domestic animals or property, when properly installed and maintained and used for its intended purpose or under conditions which can reasonably be foreseen.

2. Member States shall take all appropriate measures to ensure that partly completed machinery can be placed on the market only if it satisfies the relevant provisions of this Directive.

3. Member States shall institute or appoint the competent authorities to monitor the conformity of machinery and partly completed machinery with the provisions set out in paragraphs 1 and 2.

4. Member States shall define the tasks, organisation and powers of the competent authorities referred to in paragraph 3 and shall notify the Commission and other Member States thereof and also of any subsequent amendment.

Comment:

This item was added in Directive 2006/42/EC formally. Market surveillance applies to machinery and partly completed machinery.

In addition, the EU has implemented the following rules:

Regulation (EC) No 765/2008 setting out the requirements for accreditation and market surveillance.

REGULATION (EC) No 765/2008 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 9 July 2008 setting out the requirements for accreditation and market surveillance relating to the marketing of products and repealing Regulation (EEC) No 339/93 specifies the framework for market surveillance and complements and reinforces the provisions relating to market surveillance contained in Community harmonization legislation on market surveillance or enforcement of these provisions.

En complément, l’UE a mis en œuvre le règlement suivant :

Règlement (CE) N° 765/2008 fixant les prescriptions relatives à l'accréditation et à la surveillance du marché.

Le RÈGLEMENT (CE) No 765/2008 DU PARLEMENT EUROPÉEN ET DU CONSEIL du 9 juillet 2008 fixant les prescriptions relatives à l'accréditation et à la surveillance du marché pour la commercialisation des produits et abrogeant le règlement (CEE) no 339/93 du Conseil, précise le cadre pour la surveillance du marché et complète et renforce les dispositions relatives à la surveillance du marché figurant dans la législation communautaire d'harmonisation en matière de surveillance du marché ou l'application de ces dispositions.
